Probation Period Netherlands: What Sponsorship Doesn't Cover

Probation Period Netherlands: What Sponsorship Doesn't Cover
The assumption most people carry into a sponsored Dutch job is that the hard part is over. The IND approved the application, the contract is signed, the relocation is paid for, and the employer went through the trouble of being a recognised sponsor (erkend referent) for you specifically. None of that touches the clause that governs your first weeks. The probation period netherlands employers write into contracts (the *proeftijd*) is a mutual right to end the employment with no notice, no reason and no warning, and a sponsorship file does not soften it by one day.
This is not a prediction that you will be dismissed. Most probation periods pass without incident. It is a point about asymmetry: an employer ending a probation loses a recruitment cycle, while you can lose your residence permit's basis, your rental contract's income requirement and your health insurance arrangement in the same week. People who understand that early behave differently in month one.
What follows is the set of mistakes I see most often among internationals who have just started, and what to do instead.
Mistake one: treating proeftijd as a soft landing
In Dutch employment law the probation period sits in Article 7:652 of the Civil Code, and it works alongside Article 7:676, which is the one that actually bites. During a valid proeftijd, either party may terminate the contract immediately. No UWV permission, no court, no transition payment, no notice period. The usual Dutch dismissal machinery, which is genuinely protective once probation ends, simply does not apply yet.
That is the whole point of the clause from the employer's side. Dismissal law after probation is slow and expensive here, so the proeftijd is where companies concentrate their risk. A manager who is unsure about a hire at week nine is under real pressure to decide before the clause expires, because after that the options narrow sharply. Internationals sometimes read a sudden flurry of feedback meetings in week seven as unusual hostility. More often it is a calendar problem.
Two things that surprise people:
- It cuts both ways. You can walk out during probation with the same immediacy. That matters if the job turns out to be nothing like the role described, though as a sponsored worker your permit is tied to the employer, so leaving is a permit event and not only a career one.
- No reason is required. The employer does not have to tell you why, and in practice many say very little, because saying more creates a paper trail. Silence is not evidence that something improper happened.
Probation is not a trial with a presumption in your favour. It is a window in which normal Dutch job protection is switched off.

Mistake two: not checking how long a probation period netherlands law actually allows

Proeftijd is not a soft start; it is a legal exit clause
The length of a proeftijd is not negotiable upward, and employers get it wrong more often than you would expect. The statutory rules work off the contract duration:
- Contracts of six months or shorter: no probation period is allowed at all. A proeftijd clause in a five-month contract is void.
- Fixed-term contracts longer than six months but shorter than two years: maximum one month. A collective labour agreement (CAO) can extend this to two months in some sectors, which is one of the few places a CAO can work against you.
- Fixed-term contracts of two years or longer, and permanent contracts: maximum two months.
There is no sliding scale beyond that, and the clause has to be in writing and agreed in advance. If your contract says "three months probation", that is not a longer probation. Under Dutch law an excessive proeftijd clause is generally void in its entirety, which means there is no probation at all rather than a probation trimmed back to the legal maximum. The difference is large: it is the gap between being dismissible on the spot in week ten and being covered by the full dismissal regime.
A second trap sits in extensions. If a fixed-term contract is renewed with the same employer for essentially the same work, a new probation period is normally not permitted. Some employers try it anyway, particularly when a one-year sponsored contract rolls into a second year. Read the renewal instead of signing it the way you signed the first one, and read it alongside what a renewal does to your permit, which is covered in the permit renewal checklist.
How your contract type, your CAO and the clause interact is a legal question about your specific document. If the dates look wrong, that is worth thirty minutes with a Dutch employment lawyer or your union, not a forum thread.
Mistake three: assuming sponsorship buys job security

The assumption that breaks first: sponsorship does not buy you job security
This is the expensive one, because the logic feels sound. The company invested in sponsorship. The IND approved you. Surely nobody goes through that to let someone go in week six.
The IND and your employment contract are separate systems that touch at exactly one point: the employer reports that your employment has ended, and your residence permit loses its basis. Recognised sponsor status is something the company holds with the IND about its own compliance and reporting duties. It is not a promise to you, and the IND does not review whether your dismissal was fair before the consequences start. Being fired during probation netherlands law permits is, from the IND's side, a change in your circumstances that the sponsor must report.
There is one genuine protection worth knowing. When your employment ends and the permit is withdrawn, highly skilled migrants normally get a search period (*zoektermijn*) of three months to find a new sponsored job, and the end date follows the permit withdrawal rather than your last day at the desk. That window is real, but three months is not generous once you look at how long a sponsored search actually takes. The realistic job search timeline is the number to plan against.
People also underestimate that a probation dismissal is not the only way the floor moves. If the employer loses recognised sponsor status, you face a similar problem from a different direction, set out in the post on what happens when IND sponsor status is revoked.
Mistake four: letting the paperwork stay verbal
Dutch workplaces run on informal conversation, and a lot of early feedback happens in a corridor or a quick Teams call. That is fine until something is contested, and in probation disputes the questions are narrow and date-driven.
What gets argued about is rarely performance. It is:
- The start date of the employment, not the start date of the probation. Probation runs from the first working day under the contract. If you did two unpaid onboarding days or a week of paid "introduction" beforehand, note the dates.
- Whether the termination landed inside the window. A dismissal communicated on the final day of probation is valid. A dismissal communicated the day after is not, and then the employer has ended the contract without a valid route, which changes your position substantially.
- Whether the clause was validly agreed in writing before the work started. A clause added later, or present only in a staff handbook, is weaker than an employer assumes.
So keep the boring records: the signed contract PDF, the dated offer letter, the email confirming your start date, and any written confirmation of a termination. If a manager tells you verbally that it is over, send a short, neutral email the same day confirming what was said and when ("Confirming our conversation today, 16 October, that you are ending my employment during the probation period"). You are not building a case. You are fixing a date that may matter later, including for the IND and for UWV.
One more point. You can ask the employer to confirm the reason in writing. They are not obliged to give one during probation, but if the reason relates to something prohibited (pregnancy, discrimination on protected grounds, union activity), the dismissal can be challenged even then. Prohibited-ground dismissals are the main exception to "no reason required", and they are the one situation where getting legal advice quickly genuinely changes the outcome.
Mistake five: thinking a notice period exists during probation
There is no notice period during probation netherlands law requires. That is the defining feature of the clause. Your contract may state a one-month or two-month notice period, and that clause is real, but it takes effect after probation ends.
The implications are financial. If the employment ends on a Tuesday, your salary stops on that Tuesday. You are owed outstanding salary, accrued holiday allowance (vakantiegeld) and untaken leave days, but not pay in lieu of notice. For someone who moved countries six weeks earlier, paid a deposit and two months' rent, and has not yet had a 30% ruling decision, that arithmetic is unpleasant.
It also means you cannot count on a hand-over month to job hunt. The search starts on the day of the conversation.
What actually starts moving on day one of a dismissal
Several clocks begin at once, and they are not the same clock:
- The IND clock. Your employer reports the end of employment. The permit withdrawal and the search period follow from the IND's decision letter. Read that letter carefully for the actual dates and do not calculate them from your last working day.
- The insurance clock. Dutch basic health insurance is a personal obligation, not an employer benefit, and it does not stop because your job did. If you were on an employer collective scheme, the policy usually continues in your own name at a different premium. Cancelling it is a mistake, not a saving.
- The benefits question. WW unemployment benefit through UWV has a work-history requirement (the weken-eis) that most people a few weeks into a first Dutch job will not meet. Check rather than assume, but do not budget for it.
- The new-job clock. A new employer has to be a recognised sponsor and has to file before your search period expires. The mechanics of transferring, including the gap risk between contracts, are in the guide to changing employer on an HSM visa.
The combined permit, insurance and practical sequence after a job ends is covered in the guide to losing your job in the Netherlands, which is the right thing to read on the day rather than the week after.
What to ask before you sign the next sponsored offer
Four questions, none of which make you look difficult:
- How long is the probation clause, and does the contract length allow it? Cross-check against the rules above. A clause longer than the maximum tells you the contract was not carefully drafted, which is information in itself.
- Does a CAO apply, and does it change the proeftijd? Sector agreements can extend a one-month probation to two.
- If the role is extended or renewed, will a new probation be applied? Get the answer in the contract, not in the interview.
- What is the notice period after probation? Knowing that two-month notice starts in week nine changes how you plan.

Quick answers to the questions people actually search
Can I be fired during probation in the Netherlands without a reason?
Yes. During a valid proeftijd the employer can end the contract immediately without giving a reason, without UWV or court approval and without notice. The exceptions are dismissals based on prohibited grounds such as pregnancy or discrimination, which can be challenged even during probation.
How long can a probation period be in the Netherlands?
It depends on the contract. No probation is allowed in contracts of six months or less. Contracts longer than six months but under two years allow a maximum of one month, or two if a CAO provides for it. Contracts of two years or more and permanent contracts allow a maximum of two months.
What happens to my highly skilled migrant permit if I fail probation?
Your employer reports the end of employment to the IND and the permit loses its basis. You normally receive a search period of three months from the IND's decision to find a new job with a recognised sponsor. The dates in the IND letter are the ones that count.
Does a probation dismissal go on my record in the Netherlands?
There is no official employment record that tracks this. What exists is the reference question at your next interview and the gap on your CV. Both are manageable if you can describe the role and why it ended in two neutral sentences.
Can my employer apply a second probation period when my contract is renewed?
Generally no, if the renewed contract is with the same employer for substantially the same work. A new proeftijd in a renewal is one of the more common contract errors, and a void clause means no probation at all.
